In accordance with the act on waste electrical and electronic equipment (WEEE) of July 29, 2005, the obligations of retailers and wholesalers are as follows:

  • Provide the following information to the local authorities (wójt, mayor, city president): company name and registered headquarters address, addresses of collection points and addresses of equipment sales outlets (article 39, section 1 of the WEEE act)
  • Prepare and submit quarterly reports to the General Environment Protection Inspectorate (by the 30th day of the month following the quarter) about the weight of waste equipment collected and transferred to the processing facility (article 40, section 1 of the WEEE act)
  • Inform customers about the amount of the Waste Management Fee, if such information was provided by the introducer of the equipment (producer, importer) (article 41, point 1 of the WEEE act)
  • Provide addresses of waste equipment collection points in sales outlets (article 41, point 2 of the WEEE act)
  • Sold household equipment must be branded with the symbol of the crossed waste basket and must be accompanied by information (obtained from the Producer) about the obligation to selectively collect waste equipment, along with an explanation of the crossed waste basket symbol (article 41, point 3 of the WEEE act)
  • As of July 1, 2006 - obligation to accept, free of charge, waste electrical and electronic equipment in amounts not exceeding the amount of new equipment sold on a “one for one basis”, i.e. a refrigerator for a refrigerator, a television set for a television set, a hair dryer for a hair dryer, a fluorescent lamp for a fluorescent lamp, etc. ( article 42, point 1 of the WEEE act)
  • As of July 1, 2006 - Retailers are obligated to transfer the accepted waste equipment free of charge to a processing facility or wholesaler (article 42, point 2 of the WEEE act)
  • As of July 1, 2006. - Wholesalers are obligated to transfer the accepted waste equipment free of charge to a processing facility operator (article 42, point 3 of the WEEE act) Rights and obligations of municipalities and districts
