In accordance with the act on waste electrical and electronic equipment (WEEE) of July 29, 2005, amending the wording of the act on Municipal Cleanliness and Waste Disposal Act of September 13, 1996, municipalities are obligated to:
- Maintain cleanliness and dispose of waste in municipalities (article 3, section 1 of the MCWDA act)
- Addresses of waste equipment collection points within a municipality must be made available to residents on the municipality’s website and in other customary ways; this information must include: company name and registered headquarters address, addresses of collection points and addresses of electric and electronic equipment sales outlets (article 3, section 2, point 6a of the MCWDA act)
- Following consultation with the state district sanitary inspector, the municipal council sets forward the regulations concerning cleanliness and waste disposal within the municipality; these regulations are considered an act of domestic law (article 4, section 2 of the MCWDA act)
- These regulations determine in detail the rules of maintaining cleanliness and providing waste disposal within the municipality, including rules pertaining to managing cleanliness and waste disposal on real estate. These requirements include selective collection and acceptance of municipal waste, including household-generated hazardous waste, bulk waste and real estate refurbishment waste (article 4, section 2, point 1, sub-point a of the MCWDA Act).
- The municipal council must ensure compliance of such regulations with the municipal waste management plan within three months as of the date of passing of such a plan (article 4, section 3 of the MCWDA Act)
- The municipality is obligated to organize a municipal waste collection system for real estate owners who have not signed contracts for such services with municipal operators or licensed businesses involved in municipal waste collection (article 6, section 6 of the MCWDA Act).
- Municipal authorities can fine real estate owners in breach of regulations (article 10, section 2a of the MCWDA Act)
